I asked my company lawyer to file for EB2 since EB2 is current. This is what their response is.

Technically it should be your original receipt date , thats means your wife 140 should be processed now but guess what that happens only if TSC finds your wifes file , not sure where the tranfer cases are stored , If they use computer they will definetly find the case but looks like they find the cases by boxes ... I m in the same boat and waiting for 140 approval after transfer to TSC , hope they find our box one day

Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. I really dont care what my company policy says because as I look at it, it should be my decision whether to work on EAD or continue on H1-B. If they switch my work authorization without my knowledge, then it will be a classic case for lawsuit. Moreoever the policy is not documented anywhere.
As long as you dont use your EAD, you can continue working on H1B.
In fact, if it is the same employer as your GC sponsor, you dont have to do anything.
The thing to remember is to extend your H1B if you do a H1B transfer so you dont have any issues at the time of transfer.
All this is assuming that your company policy can handle exceptions to the policy :)

The bill also mentions that the greencard process starts after several years they being in USA they will not be interfering in EB visa catogories. There catagories are different.
I see this form so pesimistic that any bill pass in senate you will have complaint.
As per my talk to Mike Dewine's immigration fellow Bill, I raise this concern, there greencard process will be backlogs for several years, not yours. Also president make it very clear that the people who came to USA illegally have to wait for there turn and will process the application after all the legal people get there green card.
Right now this is the only deal in our plate.

(1) To carry out programs that provide education and training to establish nursing career ladders to educate incumbent healthcare workers to become nurses (including Certified Nurse Assistants, Licensed Practical Nurses, Licensed Vocational Nurses, and Registered Nurses). Such programs shall include one or more of the following:
(A) Preparing incumbent workers to return to the classroom through English as a second language education, GED education, precollege counseling, college preparation classes, and support with entry level college classes that are a prerequisite to nursing.
(B) Providing tuition assistance with preference for dedicated cohort classes in community colleges, universities, accredited schools of nursing with supportive services including tutoring and counseling.
(C) Providing assistance in preparing for and meeting all nursing licensure tests and requirements.
(D) Carrying out orientation and mentorship programs that assist newly graduated nurses in adjusting to working at the bedside to ensure their retention post graduation, and ongoing programs to support nurse retention.
(E) Providing stipends for release time and continued healthcare coverage to enable incumbent healthcare workers to participate in these programs.
(2) To carry out programs that assist nurses in obtaining advanced degrees and completing specialty training or certification programs and to establish incentives for nurses to assume nurse faculty positions on a part-time or full-time basis. Such programs shall include one or more of the following:
(A) Increasing the pool of nurses with advanced degrees who are interested in teaching by funding programs that enable incumbent nurses to return to school.
(B) Establishing incentives for advanced degree bedside nurses who wish to teach in nursing programs so they can obtain a leave from their bedside position to assume a full- or part-time position as adjunct or full time faculty without the loss of salary or benefits.
(C) Collaboration with accredited schools of nursing which may include community colleges and other academic institutions providing associate, bachelor’s, or advanced nursing degree programs, or specialty training or certification programs, for nurses to carry out innovative nursing programs which meet the needs of bedside nursing and healthcare providers.
(h) Preference- In awarding grants under this section the Secretary shall give preference to programs that--
(1) provide for improving nurse retention;
(2) provide for improving the diversity of the new nurse graduates to reflect changes in the demographics of the patient population;
(3) provide for improving the quality of nursing education to improve patient care and safety;
(4) have demonstrated success in upgrading incumbent healthcare workers to become nurses or which have established effective programs or pilots to increase nurse faculty; or
(5) are modeled after or affiliated with such programs described in paragraph (4).
(i) Evaluation-
(1) PROGRAM EVALUATIONS- An entity that receives a grant under this section shall annually evaluate, and submit to the Secretary a report on, the activities carried out under the grant and the outcomes of such activities. Such outcomes may include--
(A) an increased number of incumbent workers entering an accredited school of nursing and in the pipeline for nursing programs;
(B) an increasing number of graduating nurses and improved nurse graduation and licensure rates;
(C) improved nurse retention;
(D) an increase in the number of staff nurses at the healthcare facility involved;
(E) an increase in the number of nurses with advanced degrees in nursing;
(F) an increase in the number of nurse faculty;
(G) improved measures of patient quality as determined by the Secretary; and
(H) an increase in the diversity of new nurse graduates relative to the patient population.
(2) GENERAL REPORT- Not later than September 30, 2013, the Secretary of Labor shall, using data and information from the reports received under paragraph (1), submit to Congress a report concerning the overall effectiveness of the grant program carried out under this section.
(j) Authorization of Appropriations- There are authorized to be appropriated to carry out this section for fiscal years 2012, 2013, and 2014, such sums as may be necessary. Funds appropriated under this subsection shall remain available until expended without fiscal year limitation.
SEC. 4. COLLECTION OF DATA AND REPORTS TO CONGRESS ON FOREIGN-TRAINED NURSES NEWLY ADMITTED TO THE UNITED STATES EACH FISCAL YEAR.
(a) Requirement To Collect Data- With respect to each fiscal year, beginning with fiscal year 2011, the Secretary of Homeland Security shall collect the following data for each alien that acquires the status of a lawful permanent resident or a temporary alien worker (including as a temporary professional worker under the North American Free Trade Agreement) during that fiscal year for employment as a professional nurse:
(1) The country of residence and country of nationality of the alien at the time such status is acquired.
(2) The country or countries in which the alien received the professional education and training to be licensed as a nurse.
(3) The name and address of the petitioning employer.
(4) The name and and address of any recruiting agency used by the petitioning employer with respect to the recruitment, processing or preparation of the alien for the employment involved.
(5) The processing time for review and action on the petition with respect to each such aliens.
(b) Research of Data From Prior Fiscal Years-
(1) With respect to the fiscal years 2006 through 2010, the Secretary shall determine which of the data required to be collected pursuant to subsection (a) are available for retrieval in electronic databases maintained by the Secretary.
(2) In preparing the report for fiscal year 2011 mandated by this section, the Secretary shall include a summary of all such available data for fiscal years 2006 through 2010.
(c) Reports- The Secretary shall submit annual reports aggregating the data collected under subsection (a), and, with respect to the report for fiscal year 2011, such additional data identified pursuant to subsection (b), along with such related information as the Secretary determines to be appropriate, to the Committees on the Judiciary of the House of Representatives and the Senate not later than 90 days after the end of each fiscal year. Such reports shall include--
(1) the aggregate number of aliens who acquired a status described in subsection (a) during such fiscal year and subtotals of the status categories acquired;
(2) subtotals within each status category for the data element collected pursuant to subsection (a); and
(3) the average processing times for each different type of petition or application involved in the acquisition of status.
(d) Publication in the Federal Register- The Secretary shall cause to have published in the Federal Register notice of the submittal to the Committees on the Judiciary of the House of Representatives and the Senate of each report required under subsection (c) and of the availability to the public of each such report.

I think there is a need to educate politicians that the problem is not H1B but GC backlogs. As per USCIS only 7100 H1B's have been utilized so far for FY 2012. Unless they provide clear and time bound path to Permanent Residence, positive economic contributions from high skilled immigrants would be minimal.

I think there is a need to educate politicians that the problem is not H1B but GC backlogs. As per USCIS only 7100 H1B's have been utilized so far for FY 2012. Unless they provide clear and time bound path to Permanent Residence, positive economic contributions from high skilled immigrants would be minimal.

What do you mean by "too restrictive requirements"?? so do you think I will be better off finding another job with a different company so I can apply for a new PERM (EB2) or just wait for the appeal that is now over 6 months??
Also, I know that the reviewing officer is supposed to review my appeal request and send a copy to the appeal board so they can make a decision but he/she has not done that because I convinced the HR in my company to call the board of appeal and they said they haven't received my appeal request from the reviewing officer ( he was supposed to send it within 30 days). he has had my appeal request for over 6 months. I am not sure what to do at this stage. I feel like I am stuck.

What will the numbers reveal? I had been a regular blogger at IV, but I stopped coming up here because.
1. All talk and no Walk
2. New members come aboard, are rude and offer no pragmatic approach.
3. All these bloggers give ideas and critique each other.
4. What happened to the March1 09st rally in DC?
Why has IV not taken a pragmatic approach, don't take me wrong I respect what you have done and other approaches in the past. But IV is using same approach for a new problem, the end result-----Failure
I joined this community after july fiasco, and have kept close watch on dates, everyday members keep suggesting something or the other. I don't mind being a donor to IV or contributing little what I have, But I need to see some big movement and results.

Instead of listening to us and contacting us with disagreements he chose to take a path of confrontation and damage IV’s reputation. Such members have the courage to speak against IV but will not dare speak against websites that are working overtime to throw this community out of this country. We will not tolerate such folks as an organization that is genuinely and honestly working hard to help its community. The website he chose to post against us does not delete posts against us as it sees us as a threat to its business interests. I hope our members see the difference. Please also do not forget that past successes of IV like July bulletin and 2 year EAD was because of the hard work of our members. We need to give ourselves due credit for it. You are correct that there is talk and talk and no work. We get calls from reporters and post requirements on IV site but due to lack of response, we have to pass it. We have requests from editors asking for op-eds. Some of our members see hope in the current bills and when we told them the reality and the probability of those bills at this point of time, they get disappointed. We can also start multiple action items to vote on sites or send junk emails, but it will not do anything to help us and this is not want we want to keep doing. Each members time and effort is important and used where it will matter the most.
What really will help us is grassroots advocacy effort at this time and this is a long process. We have been doing it well over the past few years and learnt a lot from experience and mistakes. In the recent time, we did ask people to poll on the thread if they can come for a DC rally in March09. The participation was within a couple hundred I guess. We seriously want to do a big event this year in Sept Timeframe when we expect some movement of our bill. But one cannot just do at the last minute. Planning needs to happen much before the event. One or two or even 10 people cannot plan such a big event. We will need many hands. We telephoned each state chapter leader individually to talk about it. We posted their action item items and emailed them a few times. If you are not hearing from them, you may want to call them up. If they are not active, you can also take that role . We really need teams of members from each chapter ready before Sept. If a chapter wants to do a local event before that they can do it and we will support it.
Now coming to your question about core team. Core team is nothing but people like you. People have high and low times of availability like everyone else. In this bad economy there is work pressure too and everyone tries to squeeze time whenever they get. No forum postings does not mean some of them are not working. There is division of roles and having everyone come to forum and post is a waste and duplication of effort. Not everyone can have patience and availability at all times and some choose to stay away for a while or are burnt out after a long and thankless hardwork. There is no closed door. If you want to lead and be a core member to lead from the front or leader for a specific agenda, you are welcome. This is how IV can be run and managed on a long term basis even after you and I have greencards. If anyone wishes to volunteer or talk to us, let us know. at my last employer (a large, respectable financial firm), they kept saying "GC next year" till they said "GC last months of 5th year". I was just a few months from that time, but i quit them in disgust anyway. doing GC with them would have meant another 5-6 years with those creeps.
this is classic zero-sum thinking. you'll see it everywhere in the US. you just have to be sharper at seeing politics. only you can protect your interests.
my advice to IV is to associate with some labour union. those guys are corrupt, but at least they have some power.

I came to us 02 june, bought home in 03 August. I applied for GC in Sept 2006. GC has nothing to do with house. If you can get a loan and buy in a decent locality buying any time is beter than renting.

My EAD is set to expire Oct 8th 2008.
So I applied for renewal on Jun 16th via USPS express overnight mail to Texas.
I live in Pennsylvania so had to post it to TEXAS.
USCIS already cashed the check and sent me a receipt notice!
Seriously that was ultra fast.
Since they recently announced about 2 year EADs which will be issued from Jun 30 onwards, I am concerned that the fact that they cashed the check so fast, do you think they will also give me a EAD fast, that too before Jun 30th ? If they do will that be valid for one year or 2 years? If they wait for issuing, and if that happens after Jun 30, will that be a 2 year or a 1 year one?

People who left employer early or want to leave early will say it is ok; because it suits their needs.
People who plan on staying later or don't have any intention of leaving early will say to stay.
Bottom line is it is upto everyones own risk tolerance. I have just seen some of the biggest cowards in terms of immigration all of a sudden get so brave after they got the greencard.
If people are waiting years and playing it safe then what is the possible harm to wait a little longer and not get riled up by every small story of someone who got questioned at citizenship time, etc.
Immigration laws don't change very often; however, uscis interpretations and memos do change quite frequently. When you have to start hiring lawyers, go to court, face uncertainty then we'll see how brave people are.
