According to attorney Ron Gotcher Eb2 India will move up in coming months and EB3 ROW (Rest Of the World) will be current very soon. In that case, the excess EB3 ROW numbers will go to heavily retrogressed countries. This attorney's prediction is 100% correct for the April VB.

Thank you Nor Cal members, on behalf of 1 member who was unable to attend. I encourage those not already part of the Nor Cal Yahoo group to join it.
There are roughly 10 members trying very hard to boost activity without our section, and it encourages me that there were around 50 or so representatives at the meeting.
Stay active, join your chapter!
-------------
Northern California members we need volunteers for an event on Wednesday (04/25) in Campbell @ 1:00 p.m. for an hour. This is much more interactive event. No undocumented immigration issues just EB related issues. Please join the yahoo group and get involved. http://groups.yahoo.com/group/NC_Immigration_Voice/
Lets keep the momentum going.

Correct me if I am wrong, but you've had unexpired H1B while you were out of work. This is not considered unlawful presence. On top of that, violation of status determination can be done only by the USCIS (IO). If they did not inform you that you violated status, you are good to go.
correct. out of status != unlawful presence.
So being out of status for >180 days does not trigger the 3 year ban. Either USCIS must make the determination that you are out of status, or your original period of authorized stay (I-94 date) must expire.
however being out of status >180 days since your last entry into the US is problematic for your adjustment of status.

Old wine tastes good. Does this VB tastes good to you?
Yes.
Why not.
VB is the only item that keeps many to survive for the next 30 days.
Green card applicants started losing hope and dying slowly for 15 days. Then they become like a phenix birds for next 15 days, hoping that something will be there in next VB.
This cycle will go for next several generations....
We should be proud that we are going to be in history.
In 2050 school kids in US will study about "how a several thousands stuipds spent their whole lives, waited for something that never happened"

Hi,
I was going through the flatcenter PERM data for year 2004.
In the Coulm Last_sig_Event, some of data rows have value
'Received Regional Office'.
Anyboay has an idea what does this mean?.
Regards,
Alex
Yes, Once upon a time there was a zoo (When I was young and trapped into this zoo) with a name "labor processing". That zoo was divided in two trails. One trail of that labor zoo was called "State processing" and other was called "regional processing". Once the GC animal is waited long enough in "State processing" trail then it used to see the another trail "Regional Processing". There was no way to escape from the zoo via "State processing" trail. Once GC animal is entered into "Regional Processing" trail then again it had to wait a long and if got lucky at some day used to get a chance to escape from that zoo and go to the another zoo "I-140" processing with a mark "labor approved" embarked on the forehead of the animal. After many years, under the careful inspection of the authority of the zoo, it was found that there is a population surge in the stuck animals so zoo keeper decided to create a new zoo "Backlog centers"... And from then onwards you know the rest story...:)

Dear Reader,
Thank you for your interest in FSB. We admit that there was a
mischaracterization of the Capitol Hill rally in the story and it was
corrected as soon we realized the error.
We have changed the story to correctly identify the mission as a protest of
the long delays in securing green cards for highly-skilled workers already
in the U.S.
We will work to avoid errors like this in the future.
Best regards,
FSB
In response to....
"Last week 1,000 protestors-mostly legal immigrants-drew attention to the
situation of highly skilled foreigners who want to work for companies in the
U.S. by marching on Capitol Hill."
Above statement is totally wrong! you are seriously misguiding readers by your above statement... the rally was for clearing up backlog of petitions filed
for Green Cards not for increasing H1b. You should really contact the source, in this case Immigration Voice to learn what was the rally about. info@immigrationvoice.org

EXCELLENT ANALYSIS. STILL THERE ARE PROBLEMS.
The rough estimation is about 500K to 700K new 485s and same amount of EAD and AP applications will be filed in July.
1. ARE YOU SURE THIS NUMBER IS ACCURATE? 700K? SEEMS TO BE EXAGGERATED.
When they took inventory in May, there are about 40,000 documentarily qualified 485 applications were pending due to non-availability of visa numbers. The documentarily qualified 485 applications mean the application filed long time back and processed by USCIS and cleared the FBI name and criminal check, and found eligible for green card.
2.IF THESE 40K WERE OTHERWISE QULAIFIED WHY WERE THEY SITTING ON THEM UNTIL MID-JUNE ....TO START WITH? IF THEY WERE SO EAGER TO FOLLOW THE OMBUDSMAN'S GUIDELINES WHY WERE THEY SO SLOW IN USING UP THE VISA NUMBERS UNTIL MID JUNE?
However, the available visas are more than 40,000 (60to 70K). Then they made with out consulting properly with USCIS they made current for all EB categories. This is how they determine current or over-subscribed and how they establish cutoff dates.
3.MORE PRECISE DESCRIPTION WOULD BE THEY WERE COMPLETELY RECKLESS..GIVE A S+I& ABOUT HOW MUCH THEIR ACTIONS AFFECT THE CUSTOMERS.
For example, an EB3-Indian whose LC approved through fast PERM on July 30th 2007, can apply 140 and 485 on July 31st 2007 as per July visa bullet. For his PD, it will take another 10 years for the approval of 485. During this 10 year period, he/she has to live in EAD and AP and need to go for finger print every 15 month.
4.OK..... WHICH PART OF THIS AFFECTED THE STAFF AT USCIS... THE FACT THAT MANY OF US WILL ONLY HAVE EAD FOR 10 YRS OR THE FACT THAT MORE EAD RENEWALS MEANS MORE CUMBERSOME WORK FOR THEM? I'M AFRAID IT IS THE LATER.
Now, they used all 140K visas this year.
5.AREN'T THEY REQUIRED BY LAW TO SPREAD THE NUMBERS FOR EACH QUARTER? DON'T THEY HAVE LIMITATIONS ON HOW MUCH THEY CAN USE FOR EACH MONTH ETC?
The constructive approach is getting an immediate interim relief by legislation to recapture unused visas in previous years to balance the supply vs demand difference.
6.I AGREE. THIS COULD BE THE ONLY >POTENTIAL <SILVER LINING. HOWEVER, OPPONENTS WHO FOUGHT THE PREVIOUS LEGISLATIONS IN FAVOR OF US WON'T LET IT HAPPEN THAT EASILY.
THERE IS NO OTHER CHOICE OTHER THAN TRYING..

You are considered a permanent resident for tax purposes.
If you noticed carefully most mutual fund application forms ask "are you a
resident of US? " i.e they are asking you "are you a resident for tax purpsoses". You are not visiting US of r6 months or you are not trying to open an account while living in India. Just say YES;)

EB1 - all current

\/
EB2 - World current

\/
EB2 - India / China
|
| ( When above EB2 India/China gets current 2-3years? )
\/
EB3 All

\/
EB3 I/C ( When EB1 , EB2 is Current , all visa numbers will flood to EB3 right ? so may be in 4-5 years EB3 may get current ? )
EB2 I/C won't be current in the next 4-5 Years, the EB2 I/C demand till date (Today’s Date) is in the 100K - 120K Range. The EB2I/C demand till Jul/Aug 2007 is easily in the 40-45K Range so it will require a very over optimistic scenario to clear by Sep 2011. EB3 ROW will reach end of 2006 by FY 2011. So there is a very long way to go. All the movement is under many assumptions most important being the economy and unemployment, anytime this changes all spillover will collapse and there will really be no difference between EB2 I/C and EB3 I/C.

I think atleast the forums section should be made restricted to contributing members. I see many newcomers (both paying and freebies) come to this site and hoping to get a quick guidence on their immigration issue. They come here becasue they know a) they will get some answer quickly b) that answer will make sense and experinced users here who have gone through similar situation will share their insights.
Those are major outcomes or results for not paying any dime.
I can understand someone's concern about asking everyone to pay certain amount. But most of us here are earning decent wages and can contribute atleast 3$ a month (or 25$ a year) for such a service.
If those members want to contribute more as many of us do then they are most welcome to do so.
In $$$ terms of the 12K + members we can retain 40% (about 5K) and each of them contributes atleast 25$ a year (one time payment) = $75,000.00
Remember this $75K is only based on basic membership fees. Any dropouts or reduced rate of conversion will be compensated by those '20$ a month' paying members (roughly by 1 as to 10).
In short, I support this idea of having majority of forums under restricted umbrella.

I hope not. If they ban bodyshops the cap will never run out.
And people in Real companies will be able to get the visas.
Some of the US Companies, listed in NASDAQ / NYSE also provide human resource to Fortune 50 companies and they follow the LAW as requried. I do not think the provision that would prohibit employers from hiring H-1B workers and then outsourcing them to other businesses would be in this the bill, Atleast these businesses will lobby to take it out.

I think this bill is to legalize the illegals.
Powerful Hispanic caucus in Dem party would try every trick they can to legalize those who jumped the fence. Hispanics voted 4-1 for Obama so now they're in a better position to negotiate.
But, nobody is going to touch immigration before 2010 congressional elections - because (1) Economy (2) status quo favors Dems

Dont pin any hopes, only to see them come crashing down....
The dates will retrogress again as USCIS realizes the mamoth amount of applications for EB2 - India that are in the pipeline which they may not even have accounted for yet.
We are in for a long wait unless we get admin fixes or legislation...
PLease support IVs campaigns...

My H1-B expires in another 8 months. I got my Labor cleared (EB-2) in 2 months through Perm and just finished applying for I-140. Before february, if i don't get my I-140 cleared i will go through Premium and apply for H1-B 3 year extension.
Getting my H1-B extended for 3 years is my goal. Once this happens, i will look elsewhere for a new job and start over GC process again hoping thta by then labor laws improve.
I have not dreamed/hoped to get GC. I am only hoping to stay in this country as long as possible.
I still don't understand why people are frustrated with delays in GC?
Why should you even stress yourself too much about this GC. Just enjoy the life and move on.
thanks
I agree with you. Only sick ppl are frustrated with delay in GC.
