Use a competent attorney. Do not try to handle this yourself. I am sure that you have heard of "you get what you pay for"...
BTW, are you one of those cases with a 3 year degree + Experience, working in IT? If yes, the I can see why your I-140 was rejected. Lot of people have had this issue, but I do not know how many have successfully been able to resolve it.

As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.
While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year � over a 44 percent increase in the number of cases pending more than 33 months. The backlog appears likely to get worse, because a USCIS fee increase -- slated to take effect in July -- has prompted a 50 percent rise in new naturalization applications so far this year. You do not need a lawyer, I can guide you thru the process :) Yes, I know a few cases where plaintiff requested court to force the USCIS to issue EAD. Some people were waiting more than a year! Those cases were usually bundled with I-485 WoM. One case is well-known class action lawsuit Ngwanyia v.Ashcroft, No.02-CV-502 (D.Minn.). Government promised to issue EAD within 100 days for the class.

Also, this is useful for Priority Date portability, Priority Date is all your once your I-140 is aproved and you need to submit the copy with your next I-140 to use the old Priority Date, in this case also, it very useful if the employer does not share this info, and if we can get it from USCIS, we are not at the mercy of Employer anymore.
If you are seeking your i-140 for portability reasons, this means that you have already submitted I-485.
Since that is the case, then who cares if the employer will or will not revoke the I-140: IT IS STILL VIABLE for AC21 portability regardless of employer's actions.

A lot of people seem to be saying this. It seems e-filing AP usually triggers a new FP notice. If this true then it will certainly delay things. We would be better off filing AP by paper.

I filed EAD by paper to TCS and got the "Card Production Ordered" email yesterday (in 14 days) for myself and my wife. My friends who efiled just received finger printing appointment notification and no receipts. Is there same benefit with AP? Please calrify.

You may have trouble entering the country. There was an article on this very subject on murthy.com . You may search for the article with the key word.
From what I remember from that article, misdemeanors are not considered as inadmissibility, but the catch is, if the crime is a "felony" but ruled "misdemeanor" that could be treated as ground for inadmissibility. The shop lifting was given as an example of such case. I don't mean to scare you , but re-entry may not be your only issue, I think I485 approval may also be an issue.
I am sure I must have missed some thing in paraphrasing and recollecting the article, but you could search for the original article.

I wish they do the horizontal spill from other countries to India every quarter. This way the work load at the USCIS is steady. Instead they like to wait for the last 3 months. This does not give them enough time to process.

Guys,
Is this really bad news for those with pending I-140? Does it mean they expect 140 processing to be so overloaded that they can't commit to premium?
My 140/485 was filed in mid-Feb 07. Any ideas what to expect as far as 140 processing is concerned? I am pretty sure 485 processing will slow down as they will get busy with so many new applications and working on new EAD/AP applications.

Yes I am looking at the thread. I am expecting a very good forward movement(At least to 2007 Dec) in EB2 India category in the coming months.
If you see the Visa bulletin Archive for the last three years during April - Jul range theres a sharp jump in Priority dates(more than a year and more) for EB2 category. This happened during vertical fall out (This doesnt include last year because last year its horizontal fall out). So this year I am expecting the cut off dates will move at least two years ahead for EB2 India because of the horizontal fall out. For Eb3 I am not expecting any big change unless theres some immigration reform in the new OBAMA government.

Is that a 10+3+1 education?. If it is, USCIS should have denied your I140 the first time. At least, you could have re-filed in EB3. Try to open MTR as others have suggested but do not hold your breath over this and get ready to file another labor.

In most critical situations a person can file a lawsuit in federal court and ask court to 1) compel USCIS to process your EAD within 1-2 days and 2) enjoin DHS from going after the employer if person continues working with expired EAD. Part 2 is available only if employer wants to participate in a lawsuit. Otherwise, file it yourself, it requires the same amount of time as filing for EAD.
