    this whole thing sucks. USCIS cannot adjudicate even I-131 on time. We have booked our travel tickets after 100 days of Received date of AP renewal application and looks like we have to cancel our tickets and waste $1800. This really blows and its attrocity to the core that USCIS cannot process AP renewals inside 90 days time period and its a shame that they are not answerable to anyone.

    wow! I am worried about my case now. I booked tickets for Nov. Its 45 days and I haven't heard anything. I will have to expedite in about 15 days from now. I can't imagine canceling my tickets after 4 years.

    I agree. It sucks! Its like begging for something that they are supposed to provide anyway.:mad:

    Talk to a lawyer and get the answers. But if you're on travel and questioned by immigration upon entrance if you're still working for sponsoring employer, depending on the circumstances, they can take your GC away. So that's another scenario separate from an audit or citrizenship interview that GC jeopardy may arise.

    If circumstances change, like you getting laid off or fired, that's a different story. If the sponsor's intent changes, and that does happen, then obviously, you're free to move on. But you should be able to prove that, with say a termination letter, for example.



    Many of us will be facing this decision and it's good to know the risks and the answers. Imagine you got a GC and now you have a +20k offer from the other company. Staying with your current employer for 6 months will cost you 10k. The question is "does the risk cost 10k?".

    This is how I see it, please correct me if I'm wrong. You can be questioned about leaving the company only in two cases: 1. citizenship interview, 2 - investigation/audit. In first case I don't see much problem, as many years will pass, and if you will not keep any documents, I don't see how USCIS will be going back and chasing these 4-5-6 months of your employment.

    Investigation is a different story. You have to be ready. The law says that you/your employer had to have intent to work on that position with that job description forever at the moment of AOS. Technically you could change that intent the very next day.

    So.. I think this is how it will work. USCIS might request evidence/letters from you/your "after-GC" employer and if they will find something like your resume that you have sent them before getting GC, then you are in trouble. But if you will demonstrate, that let's say you met your "after-GC" employer only after getting GC (let's say at some exhibition) and he offered you right away +50k salary, then I don't see how USCIS is gonna build their case.

    I am in a similar situation. I applied for my first LC based on Skilled employee (Category 3) because my first job financial analyst only required a bechelor degree even though I have a masters degree then I filed for the I-140 (priority date May 2005). then I got a promotion to a senior financial analyst which requires a masters degree. so I automatically could apply file a second LC to file under (category 2 which is current). however my cecond LC was denied because the DOL thinks that there is no difference between the 1 job (financial analyst) and the second job (senior financial analyst) with the same company. so I checked with my lawyer and he said that I can file for appeal so the DOL will review their decision and realize that it was wrong. I did file for appeal in Sep 2006 and I ve been waiting since then. does anybody know or have any idea how long the appeal normally takes so they can make a decision on my case?? please advise. Thank you

    Meeting at hindu center in flushing on Sun evenings would not work so well due to the prayers being held during Sun evenings at the temple. I think we should poll people on when it's most conveninent for them to meet and go from there...

    and yes prayers do help too but as they say "god helps those who help themselves...so both prayers and actions are needed :)

    I agree with your suggestion, but for attorney change, do you think any bad effects? Someone told me judge and jury might question why you change attorney? We already move out that place, so no chance to contact them. Also in terms of the law, we can't access witness.
    Feel shamed on my poor English, yes, I need improve it ASAP after that jury. Thanks for your advice again!


    And who is going to be a witness, if your wife is going to take your side?
    The neighbours that complained and any other neighbours who have heard you guys in the past.
    Now, DO NOT TALK TO THESE NEIGHBOURS AT ALL. Nothing, NADA. Do not show any emotions to them, say hello if you see them and move on. If they try to talk, it is good, but DO NOT STOP TO talk. Inform your attorney about it.
    Change the attorney, if you think you are getting a raw deal.

    THis case should be dismissed.

    I believe this case is a dismissed case from the beginning. Police/lawyer have nothing else to do, I mean, they are just doing their jobs, and they cant be funny at all. They will go by what the law says. Period. Research what the law says.

    Now on the actual event:
    Everyone, I mean everyone will have disputes. Now, the dispute is so large that the neighbours call the cops? I will guarantee that every IVian here who is married for 3 years or longer (or already has a kid), has had a bad argument, where either of the spouse has screamed(or spoken with a very high tone).

    Your wife continued screaming so loud that you had to cover her mouth to pacify her, bcos she peed on herself.

    Wait a minute here, if I was a cop, I would definitely judge this as DV. Unless, you absolutely had shut up to begin with. No chair, no drag, no nothing. which now has to be proved as misinterpretation.

    And any offer that your lawyer brings you is trying to resolve the case, You are the one who should decide whether this case goes to trial or not.
    Past peeing incidences, where the neighbours heard screams should be kept in mind.

    And finally, take English lessons, dude, your written English too is very poor.
    You can actually submit this as a proof that you were misinterpreted, if this goes to a Jury trial.

    Also, please Delete any proof of the incidence, including the one posted here. No one shold be seeing the 100% truth, your 100% truth is scary.

    Thank you all very much for all your suggestions. Can I take Maternity leave for 3 months before Apr 30th and maintain in the status. Does my employer can terminate me while I am on leave?

    It is very important to maintain my status. I am sure I can find the Job before the maternity leave ends. Is there any options that I can stay in status and delay the termination for 2 or 3 months while I am on maternity leave?

    I would say even Canadian system of education is different from US. However difference in Canada is 10% v/s difference with India is 80%.
    Remember Canada is Commonwealth country and ex British Colony and their education system is amalagmation of British and US systems. So even in Canaz they will prounces Z as Zed and not as Zee as in US. They will also write cheque and not check.
    Canada educational system standards are high. In Canada public school is free like US but it goes beyond US in that even school supplies are free. You pay nothing for pen, book, paper or anything used in the classroom.
    Also in Canad there are public Catholic schools where school is run by Catholics but with government aid so you pay nothing. Something like private school with no fees. or your Indian convent schools which many of us may have been to.

    But as USCIS is putting so much "efforts" in preadjudication 1000's of cases, can't they say whether we are preadjudicated or not? They Only worry about milking us by increasing visa fee, delaying processing time and all other means...

    I dont think we need to waste our time about such non competent organizations , let them take the credit , it just shows that this was a great idea. Looking at their website it does look like they have some good contacts .

    I think immigration voice should write them a formal letter and ask them to publicise this to their "contacts" ..

    I think Wah Wah is confused by the differences between 'retrogression' and 'backlog'. Of course, you are right that the PDs are not likely to go much further back (I think USCIS took a conservative approach after July - note they are still issuing visas to those with non-current PDs but are using the bulletin to limit incoming new filings). However, if 20 million applied in July the coming backlogs would be horrendous, even though priority dates would not necessarily need to go back further.

    However, in a sense, if the backlog is perpetual, and let's say the PD never really moves forward by more than, for example, one month, in the next 10 years (I'm picking extremes to make my point) then the effective retrogression at that point would be greater than say todays.

    Phew. Anyway, I think that's what he was on about!

    That'd happen even with or without July Fiasco. If there were 20 million people with PD in 2006, as soon as the PD in VB reaches 2006, that many people will apply, and the PD will be stuck there forever. So, what my point is, July Fiasco made NO DIFFERENCE to retrogression (except the effect of some resources at USCIS spent on receipting/issuing EAD&AP).

    I agree it's very bad, and we need to fight it. But I just didn't want to people panic on something that's un-true. I'm tired of the FUD, that's it!! Just see, now in another thread somebody is speculating about discrimination against Indians inside USCIS!!

    Apparently someone flagged me.. thats fine.. if people here cannot have a proper discussion without having to flag each other I dont see any point in calling ourselves "smart" "highly skilled".. looks like we need to grow up first.     Oh no wonder this guy was sitting quite.. Probably he was waiting for everyone to leave... :D:D

    Oh I forgot to mention.. I reached home at 11 and found several envelopes laying on the floor at my doorsteps..


    I received my receipts, FP notice and EAD all at same time.. YAHHHHHOOOOOOOO


    USCIS found out that I attended IV Social Event and sent me my EAD ;)..
