    Hi,

    I need you advice.

    I have Labor and 140 cleared under EB3 (worldwide) and waiting for 485 to file. PD is December 2005. I am software developer/engineer

    I asked my company lawyer to file for EB2 since EB2 is current. This is what their response is.

    "DOL has come up with what they consider to be job classifications and separated those into the job zones. There are very few which make it to zone 5 and they include such things as surgeons, lawyers, physicists and the like, in other words highly specialized positions requiring a higher than normal education path and many years experience. There are no computer related positions listed under Job Zone 5. All our positions fall under Job Zone 4 which does not lend itself to EB2 filing. We can�t file under EB2 due to DOL restrictions to minimum requirements for positions."


    Is it true that computer professionals now can not file for EB2? Is there any way that EB2 can be filed? Is it not possible?

    No.. You can file under EB2? I dont know where you hered that from, my friend is about to file his EB2 he is in his advertisement stage.

    Second thing.. Who told you that the EB2 is current, EB2 is sitting at 11 Jan 2003 and for 5 months now. No body knows when will it move and how many days it will move......

    Even EB2 NIW is also in the same situation so how is your lawyer saying it is current. I guess you are lawyer is a barber.

    Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).

    These days USCIS is trying to stick to the rules, so all people who are trying to beat the system by using wrong credentials are getting stuck. Lawyers have nothing to lose, they will make more money from you.....one from your eb3 application and two from your high risk eb2 application which will eventually be rejected.

    So what is the general feeling about the Original GC sponsoring Job, Should we continue the Primary Job and Start a company on the sides. In my case

    1. I am not on H1B anymore
    2. I am already using my EAD with my GC sponsoring employer.
    3. My Employer is ok if i leave the company ( i have been with them for 6-7 yrs now and they have made enough from me...fair enough i think)
    4. My employer will not revoke the I-140 for sure.
    5. My client is ok to work with me if i start my own company.

    All the above points make me inclined towards starting a company and work for it, Do you think it is not advisable to change the employer specially in the case when you are starting your own company..

    Dude .... before you start bashing Dems ... they did NOT vote against the amendment.... they voted against the Budget Act waiver, Thanks best_mode for your clarification ... it makes sense ..

    Just wait.

    Once I become the citizen I will work on defeating these Senators that voted against SKIL.

    If you met any of these senators and at that time they showed hollow symapthy to you, it is time to go and meet them and hold their feet to the fire. Tell them how they lied to you and how you are disappointed.

    I am from India and I have worked in the USA for the last 6 years. I have immigrated to Canada with a Job 6 months back to avoid overystaying. My experience in Canada is very bad. I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.

    Which part of Canada are you talking about ? you may be right about the difficulty in finding jobs, but the "politeness" and "racism" part I just dont understand. From my experience of canada (BC and ontario) I can say on the whole people there were much more polite and helpful than anywhere in the US. As for racism, it exists in every country - even in the US, especially in rural areas of the south.

    :confused:I am in same situtation. I want to reenter on AP and continue on H1-B. Can I do that? My company says its their policy that once I use AP to enter I will have to switch from H1-B to EAD. I dont want to do that. Can I still continue on H1-B?

I can understand his pain, where so many new kids qualify for EB2 without any experience this gentleman is looking for MS degree to prove his 17 years of experience for EB2.

    Guys,
    First of all, please be decent to each other. Now, to the PBEC issue - this is a major problem, and a huge issue for all of us. Currently, the debate in Senate/Congress is centered around Immigration reform and this is a definitely a good time to raise these issues.

    There are a few things we should strive for:
    1. Keep all provisions of Specter's bill related to EB.
    2. Re-instate per country soft limit.

    If both of these provisions are passed, Priority dates for all countries will be current in EB2 and will rapidly move in EB3. A lot of folks in PBEC might be able to use PERM to apply another labor and priority dates will loose their importance, so it is important that these provisions pass.

    Tell your employees the actuall billing rate
    Stop Harassing them and Torturing them

    start giving them standard Benefits( Health, Vision,Dental)

    I dont think so there is gonna be much impact of my Requests to these comapnies becaue all they care is how much maximum money then can make on employee in short time.......

    I am sorry that I wasted my time searching information for you. You just wanted to rant and are looking for a shoulder to cry. You are not serious about reporting your employer to DOL. It is foolish to expect idiots like you to come out of the gutter because you just enjoy the smell of the gutter. Expecting that your rants will have any affect on people who take advantage of immigrants is extremely foolish. And expecting folks like you to stand-up for yourself and do something about this is even more foolish.

    One more thing, only desi consulting companies are not the problem. Companies who figure out a way to take advantage of its employees, will do so. All companies are in the business of making bigger bucks for its shareholders. If they can figure out a way to make more, they will, even at the cost of taking advantage of immigrants. Desi companies figured out the loop holes first. Some of the other companies followed, others are still learning. It can be argued that % of such elements in desi consulting are more because they were the first to figure out the loopholes. But desi companies are not the only group taking advantage of immigrants. They are all the same. And folks like yourself feed into the problem. So please stop blaming just the desi consulting companies, because all companies are the same. Some companies have not yet figured out the ways to take advantage of immigrant employees. But these comapnies are learning fast, because they want to be competitive, right?

    The actual problem is, the Congress. Lawmakers are the problem. They know everything what is going on. They know that not just desi companies but even larger companies take advantage of the vulnerable part of the society - the immigrants. Inspite of having all the information, the lawmakers deliberately did not add necessary protections for immigrants. And, even if the system becomes more efficient, people who enjoy the gutter will continue to live in the gutter. No laws or protections can help folks like you. Every now and then, just come to forum like these and rant once in a while. That's what you will do. The fact is you do not need better treatment or benefits. You need better therapy to tell you that you can come out of the gutter.

    Please stop ranting and stop "requesting" desi companies on forum anonymously.

    The flower campaign is apparently working as far as the attention the issue is getting.

    I don't think they mean to say that High tech workers are illegal. They say that their poll indicates Republican voters who earn more than $75000 would like a candidate who opposes illegal immigration. Atleast, that is the way I read it.

    They have to say they oppose illegal immigration because it is the WSJ. Republicans read it and they like bashing the illegals and it increases circulation.

    no that makes no sense. There is absolutely no need to mention illegals in that paragraph where they are talking about high-skilled immigrants. There is no one (well except Bernie Sanders and Tom Tancredo) who is against high-skilled immigrants. Hard to find a line against our cause, so they lump in a line about illegals? Thats plain stupid.

    When I checked the status of my FOIA request in the USCIS website, it says that it was processed on Aug 30th. But I have not received anything in the mail. How long does it take from processed date to get info in the mail? Can anyone share their experience?

    Folks,
    I don't remember many a choice at the stage of I140. I guess the lawyer made it for me. I did not bother to even find out more details, given the hopeless situation so far for EB3, India.
    My I140 says " The above petition has been approved. We have sent it to the Department of State National Visa Center(NVC). The NVC processes all immigrant visa petitions that need consular processing. It also determines which consular post is the appropriate consulate to complete visa processing. The NVC will then forward the approved petition to the consulate"

    From the above statement, it appears that this is Consular processing. Could someone confirm if this is indeed CP.
    Any idea , what needs to be done to change it to AOS. Is this a good idea?
