HAHAAHA, Yu guys are still dreaming. No more egreen cards for H1Bs doesnt matter what stage you are in. You will get queries like 'when there are so many americans without jobs, why do you need immigrants?' can any company wants to respond to this query?
Already several companies (especially american companies)received this type of audit, And they stopped filing labor and I140.Dont know what type of new audits come at 485 stage.I lost hopes of green card. I have 3.6 years left on H1. I will save whatever I can n go back to india, open a groceyr store, run it on no profit no loss purpose.
:) You will have to fight the Reliance Freshs and subhikshas etc as competitors on that grocery store.

A1: If you have an approved I-140 for the earlier PD, the answer is yes.
A2: You do not have to refile 485. Apply for PERM and get a new 140 for this PERM substituting your earlier PD. Now you will have an EB2 I-140 with the 2004 PD. There is an option to replace the 140 for an already filed 485. Just do that and you are all set.

I have sent the required employment letter to my HR. Let me see whrther they will sign it or not. I am hoping for the best. I have waited long to change my employer. It have been with them for almost 7 yrs. I am hoping for a big change.
The funny thing is that they are doing my H1B transfer, but still worried about this letter. The HR contact I have does not have much idea about these H1b/Gc process. He gets scared for everything.
Hopefully everything would work out well.

We filed I-485 july last year, but didn't file for EAD.
Now I want to file EAD for me and my wife, she is on H4 right now.
The main posting talks about filing everything together.
Anyone know which all forms I need to send when applying only for EAD? do we need send any other form than I-765?
I filed in nebraska, but case is with texas service center now. Where should I mail my forms? Texas or Nebraska?

A lot of people act as if their God / Gods need their protection. My friends think about that before getting upset about these issues. Do the Gods really need your protection? or is it just your ego thats being hurt? Would Ganesha (in this case) be hurt by being on the beer bottle? Does the picture infact resemble him? has anybody seen Ganesha? I mean, this is 21st century and we have to think rationally before becoming sentimental over these issues. So long as you get hurt over these there will be people to insult you. Believe me my friend no human can ever hurt / insult a God (if there is infact one). so why bother? Maintain your personal relationship with Ganesha in your prayer and let him deal with such insults in his way. The only reality you will ever know is your neighbuor. Do you think Lawyers used the rally to further their business and had IV as a front to project that as a H1 CAP increase ?
1) Lawyers would not do anything for free
2) At the very best - we need to have another rally in Silicon Valley to highlight
our cause with immeiate Effect, otherwise, folks can twist it as H1 rally.
We will have to explicity state Rally for
Green Cards for tax paying professionals !

Some of the US Companies, listed in NASDAQ / NYSE also provide human resource to Fortune 50 companies and they follow the LAW as requried. I do not think the provision that would prohibit employers from hiring H-1B workers and then outsourcing them to other businesses would be in this the bill, Atleast these businesses will lobby to take it out.

How abt showing the US govt - what is in it for them?
If they recapture x number of visas and y % buys a house soon after, it is a win-win situation. They provide solid ground under the feet of LEGALs and the benefactors build on top of that ground.
A key item will be to get a petition from a number of IVeans pledging to buy a house if they get a green card. If that number turns out high, this will be a good blil-board for our cause.

for everyone else too!!
