IV is not for any particular nationals. While ROW is also affected because of retrogression, India and China are severely affected and there is hardly any movement in EB2/3 for India. The hard country limits in EB system and inability to capture unused visa numbers are just 2 of the many reasons responsible for retrogression. These forums have been misused by some people to advertise about their firm. May be the other member skimmed through the post and considered it a similar ad. OP has given a fitting response. Thanks again for all answers - Another Q that i had is - i am applying for a extension of my H1 Visa. My current validity is till June 2008. My 6 years will be completed in August 2009. I have a approved I-140!
My Q is - can i apply for a 3 year extension right now based on my 140 approval.? That is - can i extend H1 from July 2008 till June 2011..?? OR do i have to wait to complete all 6 years till i can use the benefit of the 140 approval for H1 extension?

But dont you need to wait for AP approval to travel if you are in AdjustmentOfStatus Phase?

You don't necessarily need an AP to travel if you have filed for AOS. If you have a valid H1 unexpired visa you can travel on that. You wife would need to get her H4 visa stamped to come back to US.
It is a matter of choice if you want to use AP for travel or your valid H1/H4 visa.

In case one is using EAD and 485 rejected for some reason. you have 180 days to safe guard one self.

Bank denied a consumer loan ,after approval due to immigration status specifically they said no loan unless you are a citizen. i am a permanent resident , leaving in the US for over 15 years. Applying for naturalization this year. Also the same bank had approved a consumer loan 2 years ago and now they say "oh we made a mistake then". Case or no case? I think I have been discriminated against.

In some of the threads in this and other forums there was some concern expressed about non-citizen's right to hire a lobbyist or petition congress. Here is the text of the 1st Amendment of the Bill of Rights:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances
The term 'people' or 'person' in the constitution refers to inhabitants and not citizens.
Second, your members already spend a great deal on attorneys to help them with immigration issues. Our hope is that by spending a little bit on a lobbyist to get the laws fixed, we can save a lot on attorney’s fees.

MY new 140 approved with PERM. Yet to see the approval but I hope they classified me in Eb2 and placed my old PD.please see my signature for the details
I have the following questions
1. What are the different things one can do to speed up the interfile process
2. Do we need to go through medicals again, last done in 2007?
3. Do we need to go through FBI clearance, last done in late 2007?
Asking Question #2 and #3 because it costs money and I have to spend from own pocket, employer not covering from 140 onwards
Any experience, thoughts, inputs are appreciated

This is regarding status, if GC or CITIZEN there should not be any problem. If its H1B visa, then it should have validity. Means H1B visa should not have expired. I heard this story from my brother in law and in fact travel agents know this and they themselves advice on this. Those with expired H1B visa cannot travel through EUROPE. So my brother in law went to India through middle east.

Any non-profit institution which engages in research/ collaboration with an university is H1b-cap exempt. Also H1B cap-exemption is possible if you work at a non-profit/ university, but not paid by it (e.g. paid by some other company).
My wife came from India 2 months ago. She has a degree in biostatistics and is in a similar situation. If you would like to get in touch, let us know.

Dear Friend I totally agree with you. I was with one of these employers and have moved away from them. As suggested by some members you can report about these fraudulent activities to DOL. I know it is dufficult to leave these employers as they make the employees to sign bonds and try to capture all the money that they have acquired in PF etc back in the native country.
These employers are to be blamed for the current economy condition of this country and the condition of immigrants like us.
I know there are some members in this forum who will try to shout you down and make you quite.
But I feel if one believe in what is right then one should go ahead irrespective of what others think.
Now that you have left your abusive employer, would you mind disclosing your ex-employer information?

We should see how PERM came into being. Who helped PERM become a reality.

I was thinking more along the lines of transfering from US Public education school system to either ICSE, CBSE or Maharashtra Sate Board.
Upto what standard would it be relatively eay for a child to adapt and integrate into the Indian system ?

honestly i dont know. when I changed schools and in the process boards, the most difficult transition for me was from the UK board to the ICSE system. but this was almost 18 years back (man..cant believe it) ...the indian system was still learning by rote...heavily focused on tests and exams. from what i have heard recently there have been major changes specially at the elementary school level. there is less emphasis on homework and tests and more of a focus on projects and learning by doing.
As a parent of a 13 month old, if I ever decide to go back, I would probably go back before my kid is in the 4th grade. This would be because they really start establishing their identities by the time they are 8-9 years old. They can still adapt fast enough but the major focus has to be on us as parents to smooth out the transition and give them the support system they need.
If you want a seamless transition, I would agree that 1st grade is probably the best bet. By that time their accents and all can easily be adapted, without a major crisis.
